    680. THOMAS CLEMENTS was indicted for stealing one guinea, value 1 l. 1 s. the monies of William Largent .

    WILLIAM LARGENT sworn.
    On the 25th of May last, I was robbed of one guinea out of a looking glass drawer in our bed room, I often missed money out of them drawers, and could not tell which way it went; and after that I missed three guineas out of seven, and my wife marked three guineas on purpose to detect the thief, and the prisoner went to Hounslow, and when he returned three guineas was taken out; my wife informed me the drawer was open, and one guinea out of the three was gone; I went immediately, suspecting what he had told me before, I fetched a constable, and knowing him a violent lad, I fetched a porter to take him with the constable, because he had said he would tip two the double; there was nothing found upon him, but he told me he had the money in his shoes when he was first taken before Alderman Plomer, and there he declared he changed his last guinea the next door to me, and I asked him afterwards where he had taken that guinea from which he changed at the baker's; he said out of the same drawer he took the others; he said he had not taken above ten guineas from there, it was in a bag in the drawer.

    Did you trace any money to his hands that he had taken away? - Never before.

    Did you then? - The guinea is now in Court.

    I am a constable of Bishopsgate, I had this guinea at my Lord Mayor's, before Alderman Plomer, he had it from the baker, the baker is ill in bed.

    Court to Mr. Largent. Did you tell him you had received ever a guinea from the baker? - I found this guinea at the baker's.

    What is the mark? - I never knew it, my wife marked it.

    Mrs. LARGENT sworn.

    I marked the guinea with a black mark on the fleur-de-lis.

    Can you be sure of that mark again? - Yes, I could pick it out of five hundred if I had them; I am sure this is the guinea.

    Court to Prosecutor. Did you receive that guinea your wife has in her hand from the baker? - Yes, the baker's name is Corneck.

    After you had got this guinea from the baker, did you ask the prisoner any questions about it? - Yes, I did, and he said before Alderman Plomer that he changed it there.

    Did you make any promises to the prisoner before he made his confession? - None at all; when Alderman Plomer said, how many do you think you took out of the drawer, he said about ten, then said the Alderman you are like to be hanged, and I said I hope you will recommend him to be sent abroad, and not take his life away.

    Prisoner. I changed the guinea there the over night, my master picked it out of more gold and silver, the prosecutor then said he could not swear to it.

    He was tried at Old Bailey, London on 7 July 1784 for stealing cash with a value of 21 shillings. He was sentenced to transportation for 7 years and left England on the Scarborough aged about 23 at that time (May 1787). He had no occupation recorded.

    In the name of God Amen, I William Largent of Houndsditch, London, cork cutter, being of sound disposition, mind, memory and understanding, do make publish and declare those present to be and contain my last Will and Testament in manner and form following.

    First I commend my soul into the hands of Almighty God who gave it and my body I commit to the earth to be decently buried at the discretion of my executors hereafter named. And as to all my worldly estate and effects both real and personal I give devise and bequeath the same as follows.

    First I give and bequeath to my brother Benjamin Largent all my wearing apparel as well linen as woollen.

    I give and bequeath to my father James Largent the sum of ten pounds per annum to commence and be accounted from the day of my decease to be paid him quarterly by my executors hereafter named for and during the term of his natural life.

    Also I give and bequeath unto my wife Ann Largent her executors and administrators all my household furniture and implements of household plate, linen and china which I shall be possessed of at the time of my decease, to and for her and their proper use and benefit.

    Also I give and bequeath unto William Pugh and Sarah Pugh, children of William Pugh of Houndsditch aforesaid Gentleman, each and their executors and administrators the sum of fifty pounds a piece to be paid within six months after my decease.

    I give devise and bequeath unto Thomas Pugh of Holywell Street, Shoreditch, in the county of Middlesex, Gentleman, and the said William Pugh of Houndsditch aforesaid, Gentleman, and their heirs and assigns forever all those my six freehold cottages, messuages or tenements, lands or premises, situate lying or being at or near Botesdale in the county of Norfolk, with the appurtenances thereunto belonging and also all those my other freehold messuages and premises situate lying or being in or near Butlers Alley, Grub Street, in the city of London aforesaid. To hold the same freehold cottages, messuages or tenements, lands, deeds and premises unto the said Thomas Pugh and William Pugh, their heirs and assigns forever, upon trust nevertheless to and for the several ends, intents and purposes herein after declared concerning the same.

    That is to say upon trust that the said Thomas Pugh and William Pugh or the survivors of them, their heirs, executors, administrators or assigns, or the heirs, executors, administrators or assigns of the survivor of them do and shall as soon as conveniently may after my decease do sell and dispose of the said freehold messuage or tenements, land and hereditaments and premises by public sale or otherwise for the most money that can or may be reasonably had or got for the same, and the money to arise by such sale after deducting all such costs, charges, damages and expenses which they the said Thomas Pugh and William Pugh or either of them there or either of their heirs, executors, administrators or assigns shall or may be at pay expend, disburse, or be put unto in or about the sale and disposal thereof, then upon trust to lay out and invest the monies arising by such sale upon the same trust and to and for the same and intents and purposes as are hereafter of and concerning my personal estate and to and for no other use, trust, interest or purpose whatsoever.

    And as to all my stock in trade, book, debts, notes, bills, bonds, mortgages, specialities, securities for money, ready money, leasehold estates and also all the rest, residue and remainder of my real and personal estates of whatever nature or kindsoever or wheresoever situated standing, lying or being, I give devise and bequeath the same and every part and parcel thereof unto the said Thomas Pugh and William Pugh, their heirs, executors, administrators and assigns forever and for such term and estate as I have therein and to and for the interests and purposes hereafter mentioned expressed and declared of  and concerning the same.

    That is to say In trust as soon as conveniently may be after my decease to make sale and disposal thereof together or in parcels either by public sale or private contract unto any persons or persons whomsoever for the best price or prices in money that can be reasonably had or gotten for the same, and the monies arising from such sale upon trust in the first place to pay and satisfy all such debts as shall be lawfully due and owing from me at the time of my decease, my funeral expenses and the legacies herein before given and bequeathed and the charges of proving this my will and in the next place upon trust out of the first money which shall come to their hands either by the sale of the said freehold hereditaments lands and premises herein before described or out of any part of my personal estate to raise the sum of one thousand five hundred pounds and lay out and invest the same in the purchase of government securities in some of the public funds in the names of the said Thomas Pugh and William Pugh or the survivor of them, and interest or dividends arising there from to be from time to time paid to my said wife Ann Largent or otherwise to permit and suffer her to receive the same for and during the term of her natural life and from and after the decease of my said wife then upon trust that the said funds or securities so to be purchased with the said sum of one thousand five hundred pounds shall be equally divided among and between all and every my child and children as well now born at the time of my decease as those born in due time afterwards.

    If there shall happen to be more than one living at the time of my decease in and by equal shares and proportions to be assigned and paid to them my said children respectively on their attaining their respective ages of twenty one years and such share to be considered and taken as vested interest from the time of their respective ages of twenty one years notwithstanding my said wife Ann shall then be living, and I direct that the dividends and interest or produce of such shares respectively shall in the meantime after my said wife's decease be applied in the maintenance, education and bringing up my said children respectively until they shall attain their respective ages of twenty one years by my said executors, the survivor of them,  or the executors or administrators of such survivor, and if it shall happen that any such child or children shall happen to depart this life before he she or they have respectively attained his her or their ages of twenty one years then I direct that the part or share of him her or them so dying shall go to be in trust for and to be divided among the survivor or survivors of them in and by equal shares and proportions and shall be transferred aforesaid or paid and payable to them respectively in upon their attaining their respective ages of twenty one years and the dividends and interest thereof  to be in the meantime applied in or towards their respective maintenance and education but if there shall be only one such child or if there shall be more than one and all of them except one shall happen to die under the age of twenty one years then upon trust only for such surviving child to be transferred aforesaid or paid and payable by my said executors or the survivor of them or the executors or administrators of such survivor at his or her age of twenty one years and the dividends and interest thereof or a sufficient part thereof to be in the meantime after my said wife's decease paid or applied to his or her maintenance or education.

    And as to the remainder of the said monies to arise by the sale of my said freehold estates as also of my personal estate and effects herein before by me given devised and bequeathed unto the said Thomas Pugh and William Pugh and the survivor of them and the executors and administrators of such survivor upon trust to lay out and invest the same by the purchase of government securities in their names and that my said executors shall stand possessed thereof upon trust that the said funds or securities so to be purchased with such remaining money as last above directed shall be equally divided unto and between all and every my said child and children as well those born at the time of my decease as those born in due time after my decease in and by equal shares and proportions to be assigned and paid to them my said children respectively on their retaining their respective ages of twenty one years and the interest and dividends which shall from time to time arise from such stock or funds so to be purchased as aforesaid I direct that the same or so much and such part thereof as the said Thomas Pugh and William Pugh or the survivor of them or the executors or administrators of such survivor shall think necessary shall be applied in the maintenance education and bringing up my said children respectively until they shall attain their respective ages of twenty one years and in case it shall happen that any such child or children shall die before he she or they shall have respectively attained his her or their respective ages of twenty one years then I direct that the part or share of him her or them so dying shall go to and be in trust for and to be divided among the survivors and survivor of them in and by equal shares and proportions and shall be transferred assigned and paid or payable to them respectively upon their attaining their respective ages of twenty one years to be with such share of the interest or dividends due in respect thereof and unapplied for the purposes aforesaid but if there should be only one such child or if there should be more than one and all of them except one shall happen to die under the age of twenty one years then upon trust for such only surviving child to be transferred assigned or paid and payable by my said executors or the survivor of them or the executors or administrators of such survivor at his or her age of twenty one years together with all such interest or dividends as shall be due for or in respect thereof and unapplied for the purposes aforesaid.

    And in case it shall happen that all my said children shall happen to die before they shall have attained their respective ages of twenty one years then it is my mind and will and I do hereby direct my said executors or the survivor of them or the executors or administrators of such survivor to transfer assign and pay the whole of the said stock or funds so to be purchased with the whole of my estate and all dividends or interest due in respect thereof and unapplied unto my said wife Ann in case she shall then be living but in case she shall then be dead in trust to assign transfer and pay over the whole of such stock fund and securities and all the unapplied interest and dividends unto such person or persons as my said wife by her last will and testament in writing or any writing purporting to be her last will and testament attested by two or more creditable witnesses shall direct and appoint and for want of such direction or appointment then to such person or persons as shall entitled to the same according to law and the distributions of intestate estates and to for no other use, trust, intent or purpose whatsoever and I hereby charge all my said personal estates with the payment of the said annuity or clear yearly sum of ten pounds per annum herein before by me bequeathed to my father.

    And I do hereby direct that my said executors or the survivor of them and the executors or administrators of such survivor shall not be answerable or accountable for more of the said trust moneys than they or either of them shall actually receive by virtue of this my will nor with or for any loss, misappropriation or non application thereof or of any part thereof so as the same happen without care, their wilful default or neglect nor the one of them for the other of them or for the arts, deeds, receipts, neglects or defaults of the of them but each of them for his own arts, deeds, receipts, neglects and defaults only and that it shall be lawful to and for my said executors or the survivor of them or the executors or administrators of such survivor in the first place by and out of the said trust monies to deduct and reimburse him and themselves all such loss, costs, charges and expenses as he, they or any of them shall sustain, expend or be put unto by reason of the trusts aforesaid or any of them or the management or execution thereof respectively or in any other manner or thing in any wise whatsoever thereto.

    And I do hereby nominate, constitute and appoint the said Thomas Pugh and William Pugh executors of this my will and trustees and guardians of my said children and I do hereby revoke and make void all former will and codicils by me at any time heretofore made and do declare this only to be my last will and testament.

    In witness whereof I the said testator William Largent have to those present contained and written in four sheets of paper to the three first thereof set my hand and to the last thereof both my hand and seal and I have also affixed my seal to the ribbon that fastens the same together at the top thereof, this first day of March in the year of our Lord one thousand seven hundred and ninety one.     This will was proved at London the twenty ninth day of July in the year of our Lord one thousand seven hundred and ninety three before the worshipful James Henry Arnold Doctor of Laws and surrogate of the Right Honourable Sir William Wynne Knight also Doctor of Laws, Master Keeper or Commissary of the Prerogative Court of Canterbury. Lawfully constituted by the oaths of Thomas Pugh and William Pugh the executors, named in the said Will to whom administration was granted of all and singular, the goods, chattels and credits of the deceased having been first sworn duly to administer.

    This is the last Will and Testament of me Mary Largent of No 31 Grafton Street, Fitzroy Square in the county of Middlesex, spinster. First I direct all my just debts funeral and testamentary expenses to be duly paid.

    Whereas I am possessed of or entitled to the sum of three hundred pounds three pounds percent Consolidated Bank Annuities now standing in the names of me and of Charles Pugh and Isabella his wife and Anne Pugh the daughter of the said Charles Pugh and I am also possessed of or entitled to the sum of forty two pounds per annum Long Annuities also standing in the books at the Bank of England in the same names and I am also possessed of or entitled to the sum of three hundred pounds secured to me by the promissory note of the said Charles Pugh payable twelve months after date with interest at five pounds percent but should I survive the termination of the said Long Annuities the said sum of three hundred pounds three pounds percent Consolidated Bank Annuities and the said sum of three hundred pounds so occurred as aforesaid or out of such sums may be reduced and lessened by me in my lifetime, now I do hereby give and bequeath the said sum of forty two pounds per annum Long Annuities or so much thereof as shall remain at the time of my decease in manner following and direct that the said Charles Pugh and the said Isabella Pugh and Anne Pugh and the survivors and survivor of them shall stand possessed thereof upon the trusts and for the intents and purposes following, that is to say. Upon trust to transfer the said forty two pounds per annum Long Annuities or so much thereof as shall remain at my decease unto my great nephew Robert Willes to be held by him in trust for the use and benefit of such of his children as shall be living at the time of my decease. And I declare that the receipt of the said Robert Willes shall fully discharge the said trustees and that the said trustees shall not nor shall the executors of this my Will be bound to see to the application of the said Long Annuities nor be responsible for the loss or misapplication thereof.

    I give and bequeath unto my great niece Mary Ann Willes the sum of forty pounds also all my wearing apparel, also one equal half part of my household linen, the equal division whereof between my said great niece and my said great nephew Robert Willes I direct shall be entirely in the judgement of my executors. I also give to my said great niece a mahogany chest of drawers, my work table and tea caddy and the several articles of plate next mentioned videlicet, two silver salt spoons, one silver pepper box, one silver cream pail and ladle, one tea caddy spoon, one pair of best table spoons, two small figured spoons, one pair of tea tongs, three plain tea spoons, one other table spoon.

    I give and bequeath unto the said Robert Willes the other equal half part of my household linen and all the rest of my household furniture not herein before specifically given to my said great niece, also the following articles of plate, that is to say, two silver salt spoons, one silver milk jug, one pair of best table spoons, five best tea spoons, one silver pepper box, one dessert spoon, two other table spoons.

    And to the aforesaid sum of three hundred pounds three percent Consolidated Bank Annuities or so much thereof as shall remain at my decease and as to the said sum of three hundred pounds or so much as may remain at my decease subject to the payment of my debts funeral and testamentary expenses and legacies I give and bequeath the same as follows, that is to say.

    I give and bequeath the sum of forty pounds unto Mr John Harmer and Miss Sarah Harmer of No 5 Ferdinand Cottages, Hampstead Road in trust for the four children of my late great niece Sarah Harmer formerly Sarah Willes, videlicet Emily, Caroline, Frederick Thomas, and Harriott Harmer, which sum I direct shall be expended by them for the benefit of the said four children in such way and manner as the said John Harmer and Sarah Harmer or the survivor of them shall think fit, and I direct that the receipt of the said John Harmer and Sarah Harmer shall discharge the said trustees and my executors and that they shall not be obliged to see to the application thereof nor be made liable or accountable for the misapplication thereof.

    And as to all the rest residue and remainder of the said monies and all the rest and residue of my estate and effects as well real as personal I give devise and bequeath the same unto the said Mary Ann Willes and Robert Willes their heirs executors administrators and assigns absolutely as tenants in common and not as joint tenants.

    And I appoint the aforesaid Charles Pugh and Isabella his wife and Anne Pugh executor and executrixes of this my Will and declare that it shall be lawful for them and each of them to deduct and retain and also to allow to each other out of the residuary estate and also out of the said trust funds and monies all costs charges and expenses which they, any or either of them shall or may pay, incur and sustain or be put to in carrying this my will into effect. And lastly I revoke all former Wills.

    In witness whereof I the said Mary Largent have to this my last Will and Testament contained in three sheets of paper set my hand to and at the foot of each sheet thereof this nineteenth day of June in the year of our Lord one thousand eight hundred and fifty seven '96 Mary Largent '96 signed and declared by the said Mary Largent the Testatrix as and for her last Will and Testament in the presence of us present at the same time who was at her request in her presence and in the presence of each other have hereunto subscribed our names as witnesses '96 Saml.     Proved at London 7th March 1864 by the oaths of Charles Pugh, Isabella Pugh (wife of the said Charles Pugh) and Anne Pugh spinster, the executors to whom Admon was granted.

    On the 7th day of March 1864 the Will of Mary Largent late of No 31 Grafton Street Fitzroy Square in the county of Middlesex spinster deceased, who died on the 20th day of November 1862 at No 6 Blackman Street in the Borough of Lambeth in the county of Surrey was proved in the Principal Registry of Her Majesty's Court of Probate, by the Oaths of Charles Pugh of No 6 Blackman Street aforesaid Auctioneer, Isabella Pugh (wife of the said Charles Pugh) of No 6 Blackman Street aforesaid and Anne Pugh of No 6 Blackman street aforesaid spinster, executors named in the said Will they having been first sworn duly to administer.
